Quintessential Pepper LLC (“Company”, "ListCharming", "we", or "us") offers ListCharming ("Site") through our site, www.listcharming.com according to the terms and conditions set forth below. This agreement governs your use of ListCharming and all services offered through our website. By accessing or using the Site or Service, you signify that you have read, understood, and agreed to be bound by this Terms of Use ("Agreement"), whether or not you are a registered user of our Site. Please read it carefully.

Service Fee

ListCharming does not charge a set-up fee. Registrants pay a 3% fee of the gift amount for using ListCharming's services. Additionally, gift givers pay a specific cost related to the transaction. This transaction fee is external to ListCharming and charged by our payments partner, and the amount depends on the payment method and country of origin. Registry Balance Payment

Each individual gift is available for redemption after the payment clears. Most payments clear within 5 business days.

Registry balances are paid out on request. Visit the Transfer Gift Funds page to make that request. All transfers, including Bank check, bank ACH, and international wire transfers, will only be issued in the name(s) given when the registry is published.

Gift Refunds

If you are not satisfied with your purchase for any reason, we will refund you 100% of the purchase price upon receipt of the gift from the recipient or within one business day if the gift has not been delivered. ListCharming encourages gift givers to email us if there has been an error regarding the amount of the gift or the registry it was intended for.

Disputed Gift(s)

If a gift giver disputes a valid charge from ListCharming and the registry in question still has the disputed gift(s) as part of its current balance, the value of the gift will be deducted from said registry balance. If the registry has no current balance, the disputed amount will be held back from any future gifts they may receive. ListCharming will contact the gift giver in an effort to rectify any situation involving disputed gift(s).

Closing Your Account

At any time, you may disable your account and receive the remainder of your balance (minus the service fee). Users have the ability to disable their account from the settings of the website. Disabling a registry removes the registry page and removes the registry from search results.

Unclaimed Balances

A registry with a balance that is not redeemed two years after the wedding date will be closed. ListCharming will attempt to contact the user(s) via email and a letter two months before the two year period.

User Registration and Removal from Site

You attest that all information provided in the registration process is true and accurate. ListCharming may at its sole discretion and without further notice remove you, your content, or prohibit you from using the Site without prior notice.

Content

All information, text, messages, and any other material posted on ListCharming by users is the sole responsibility of that user from which the information originated. Members indemnify ListCharming for the content posted to listcharming.com. ListCharming reserves the right to monitor any and all information transmitted or received through ListCharming at any time. ListCharming at its sole discretion and without further notice to the user may remove or prohibit user content that ListCharming deems inappropriate. Registry pages are accessible to all visitors to ListCharming. This includes automated search engine spider applications that catalog listcharming.com for Internet searches. By submitting your content you grant the right to said content to ListCharming.

Taxation Consequences

Furthermore, the user agrees that ListCharming has no obligation to maintain records or provide you with documentation of your transactions with charitable/non-profit organizations for tax reporting purposes.

Right to Change Terms of Use, modify, and discontinue ListCharming

The Company reserves the right to change the Terms and Conditions at any time and without prior notice to the Member, but such changes will be effective only when they are posted to the Terms section of listcharming.com. Quintessential Pepper, LLC reserves reserves the right to modify or discontinue listcharming.com at any time without notice after distribution of registry gift balances minus any applicable service fees

Claim Relating to Terms and Conditions

If any provision in this Terms and Conditions is invalid or unenforceable under applicable law, it will be enforced to the furthest extent possible and the remaining provisions will continue in full force and effect. This Terms and Conditions, your rights and obligations, and all actions contemplated by this Terms and Conditions will be governed by the laws of the United States of America and the State of Delaware (except with respect to choice of law), as if the Terms and Conditions were a contract wholly entered into and wholly performed in Delaware. Any dispute, controversy or claim arising out of or relating to this Terms and Conditions will be resolved exclusively in the federal or state courts located in Wilmington, Delaware and you hereby consent to the jurisdiction and venue of such courts.
